Apple and Qualcomm trials move patent lawsuits out of Texas, but failed

The U.S. Court of Appeals for the Federal Circuit ruled that Apple and Qualcomm could not transfer a long-term patent case from Texas to California for review. In March this year, US District Court judge Alan Albright of the United States District Court of Texas West District ruled that the case should remain under trial in Texas, on the grounds that both companies have relevant business operations locally and should not be transferred to California, where their headquarters is located.
Apple and Qualcomm later filed a lawsuit with the Federal Circuit Court, trying to overturn the district judge's decision, hoping to transfer the case to the ground. However, according to the report of "Law360", this complaint failed.
The two companies took the lead, and most important witnesses and documents are easier to obtain in California. Most of the past technical inventors were located in Northern California. In addition, some internal documents are difficult to obtain in Texas. However, the court pointed out that the two companies did not prove that the witnesses refused to appear in court to make a case, nor did they specify which documents would be difficult to access in Texas.
The court said in a ruling released on Tuesday that Apple and Qualcomm did not meet the "requiring strictness" standard and could not prove that Judge Albright clearly used discretion and that they did not make a certificate of specific restrictions in their original application. Therefore, this patent lawsuit will continue to be reviewed in Texas.
